II. Purpose and scope of the privacy policy

1. Galaximatic Ltd. understands the privacy concerns of the visitors to this Website regarding the protection of personal data and is committed to protect their personal data by applying all the standards for protection of personal data in accordance with the Personal Data Protection Act and Directive 95/46/EC. With this Privacy Policy, Galaximatic Ltd. respects the privacy of individuals and undertakes every effort to protect the personal data of individuals against unlawful processing by applying the technical and organizational measures set forth in the Personal Data Protection Act, which measures are entirely consistent with state-of-the-art technological developments and provide a level of protection that corresponds to the risks associated with the processing and the nature of the data that should be protected.

2. With this Privacy Policy and in compliance with the requirements of Article 19 of the Personal Data Protection Act, Galaximatic Ltd. provides information on:

  • the purpose of the processing of personal data;
  • the recipients or categories of recipients to whom the data may be disclosed;
  • information about the mandatory or voluntary nature of provision of personal data and consequences of refusal to provide the data;
  • information on the right of access and right to rectify the collected data.

III. Definitions

3. For the purposes of the Personal Data Protection Act and this Privacy Policy, the following terms shall have the following meaning:

  • Personal data shall refer to any information relating to an individual who is identified or identifiable, directly or indirectly, by reference to an identification number or to one or more specific features.
  • Processing of personal data shall mean any operation or set of operations which can be performed with respect to personal data, whether by automatic means or otherwise, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, provision, transfer or otherwise making available, updating or combination, blocking, deletion or destruction.
  • Personal data register shall mean any structured set of personal data, which is accessible according to specific criteria, whether centralized, decentralized or distributed on a functional or geographical basis.
  • Personal data processor shall mean any natural or legal person, a central or local government authority, which processes personal data on behalf of the personal data controller.

  • Recipient shall mean a natural or legal person, an authority of central or local government to whom personal data are disclosed, whether a third party or not. Authorities which can receive data in the framework of a particular inquiry shall not be regarded as recipients.

IV. Personal data processed by Galaximatic Ltd.

The category of personal data that Galaximatic Ltd. processes as a personal data controller is structured in two personal data registers ("Personnel Register" and "Contractors Register"), which are declared and entered into the Public Register of Personal Data Controllers. 5. When collecting and processing personal data Galaximatic Ltd. collects and processes personal data, which are provided directly by the individuals, for whom the data relate and are necessary for:

  • the provision of the services that the company offers;
  • drafting and conclusion of agreements.

6.1. Galaximatic Ltd. collects and processes only the following data, which are related to the physical identity of individuals, namely:

  • name;
  • address;
  • e-mail address;
  • phone number.

6.2. Galaximatic Ltd. collects and processes data related to the company in which the individual is a managing director for the purposes of drafting of agreements and invoicing purposes, such as:

  • name of the company;
  • UIC;
  • seat and registered address;
  • if the company is VAT registered or not.

V. Technical information collected and processed by Galaximatic Ltd.

7. Technical information means information, which does not have the character of personal data, and through which visitors to the website cannot be personally identified. This information is automatically collected and stored on the server. This information includes:

  • Internet Protocol address (IP) of the device from which you access the platform (this is usually used to determine the country or city from which you access the Platform);
  • type of the device from which you access the platform (for example: computer, mobile phone, tablet, etc.);
  • type of operating system;
  • type of browser;
  • concrete actions that you undertake on the Platform, including pages visited, frequency and duration of visits to the Website;
  • date and time of visits;

Buttons, tools and content from other companies

The Website contains buttons, tools and content, which connect to other companies' services such as a Facebook "Like" button as well as links to the company's profile in various social media and more. Information on the use of these elements can be also collected. VI. Purposes of personal data processing

9. Galaximatic Ltd. collects and processes the personal data of individuals for the following purposes, namely:

  • to provide the services that the company offers and identify individuals (future and current clients);
  • for the execution of an obligation of the personal data controller, stipulated by law, arising from the requirements of the Accountancy Act, the Value Added Tax Act, the Law on Obligations and Contracts, the Tax and Social Insurance Procedure Code;
  • for the execution of obligations of a contract to which the individual to whom such data refer is a party, and for actions at the individual’s request and preceding the execution of a contract;
  • for accounting purposes;
  • for direct marketing.

VII. Mandatory and voluntary nature of provision of personal data

10. The personal data required to be provided by the individuals are in accordance with the services offered by Galaximatic Ltd. and are mandatory. The provision of personal data by individuals is voluntary. In the event that the individual refuses to provide the personal data, Galaximatic Ltd. will not be able to provide the service requested by the individual.

VIII. Processing of personal data

Galaximatic Ltd. processes the personal data of individuals through a set of operations which can be performed by automatic or non-automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, provision, transfer or otherwise making available, updating or combination, blocking, deletion or destruction.

12. Galaximatic Ltd. processes the personal data of individuals independently or by assigning the processing of personal data on behalf of the company, which are the accountants of the company.

Galaximatic Ltd. undertakes the appropriate technical and organizational measures to protect the personal data against accidental or unlawful destruction, or against accidental loss, unauthorized access, alteration or dissemination, as well as against other unlawful forms of processing. 14. Galaximatic Ltd. has the right to disclose the personal data processed to the following categories of persons, namely:

  • to individuals to whom the data relate;
  • to individuals, if provided in a legal act;
  • to individuals, processing personal data.

XI. Rights of individuals and procedure to exercise the rights

Rights of individuals

A. Right of access:

15. Any individual who has provided personal data to Galaximatic Ltd., shall be entitled to access the personal data relating to him/ her. When exercising his or her right of access, an individual shall be entitled to request, at any time, from Galaximatic Ltd.:

  • a confirmation as to whether or not data relating to him/her are being processed, information as to the purposes of such processing, the categories of data concerned, and the recipients or categories of recipients to whom the data are disclosed;
  • a notification to him/her, in an intelligible form, containing his or her personal data that are being processed, and any available information about their source;
  • information concerning the logic involved in any automatic data processing concerning him/her, at least in case of automated decisions referred to in Art. 34b of the Personal Data Protection Act.

Galaximatic Ltd. provides the above mentioned information free of charge.

B. Right to erase, rectify or block:

16. Any individual who has provided personal data to Galaximatic Ltd., shall be entitled to require, at any time, from the company to erase, rectify or block his or her personal data whose processing does not comply with the provisions of the Personal Data Protection Act and to notify any third parties to whom his or her personal data have been disclosed, of any erasure, rectification, or blocking which has been carried out, except where this is impossible or involves excessive effort.

C. Other rights:

17. Any individual who has provided personal data shall be entitled:

  • to object to Galaximatic Ltd. against the processing of his/her personal data on the basis of legitimate grounds. When such objection is justified, the personal data of the relevant individual may no longer be processed;
  • to object against the processing of his or her personal data for the purposes of direct marketing;
  • to be informed before his or her personal data are disclosed for the first time to third parties or used on their behalf for the purposes of the direct marketing, and to be given the opportunity to object to such disclosure or use.

Procedure to exercise the rights

18.1. The individual exercises his or her right of access and right to erase, rectify or block, by submitting a written request to Galaximatic Ltd., which should contain the following information:

  • the name, address, and other data necessary for identifying the respective individual;
  • a description of the request;
  • the preferred form of provision of the information;
  • signature, date of submission of the request and mailing address.

18.2. The request may also be submitted in electronic form under the procedure laid down in the Law on Electronic Documents and Electronic Signature. The request shall be filed personally by the individual or by explicitly authorized person with a power of attorney certified by a notary public. Galaximatic Ltd. keeps the requests filed by the individuals in a separate register.

18.3. Galaximatic Ltd. considers the request and shall take a decision within 14 days from its submission. Galaximatic Ltd. answers by a written response, which shall be provided to the individual personally against a signature or acknowledgement of receipt by mail. Lack of response is considered a denial.

18.4. Galaximatic Ltd. denies access to personal data when such data do not exist or their provision is prohibited by law or denies full or partial access when such provision would threaten the defense or national security, or the protection of classified information and this is stipulated in a special law.

XII. Changes to the privacy policy

19. This Privacy Policy may be updated at any time in the future. When this happens, the revised Policy will be posted on this Website with a new "Last Updated" at the top of this Privacy Policy and will be in force from the date of publication. You are therefore advised to periodically check this Privacy Policy to make sure that you are familiar with any changes. Using the Website after publishing the updated Privacy Policy, you will be deemed to agree with the changes made.
